中美著作权法都规定了“合理使用”（“适当引用”，fair use）的条文：

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
按美国版权法，判断是否合理使用，需要考虑4条因素：
1. 使用的目的
如果用于商业目的，则更可能侵权；如果用于非盈利教育目的则更可能属于合理使用。alt.chinese.text是公共论坛，新语丝是在美国注册的非营利机构，发表在上面的作品不存在任何盈利目的。出版书籍则存在盈利目的，但相对于其他商业目的（例如商业广告），盈利程度轻微。

复制还是复述，使用了原作的文字、表达方式还是观点，在多大数量和程度上使用了原作的文字、表达方式。观点本身不受版权保护。
4. 对原作的潜在市场或价值是否造成了损害
方舟子的作品毫无疑问未对根伯教授的作品造成任何损害。
