That is if a person is convicted for crime type A and was senetnced to 6 months. But on pater that crime is punisble by no more than 3 years, then 3 years is maximum possible sentence and USCIS use that 3 years to measure teh seriousness of the person's crminal history
in detrminening inadmissibility and removability and other immigration benefits
