insurance companies usually tape people in public places anyway, so no problems there.
private detective that someone hired to tape his/her spouse having sex with 3rd party invades privacy but the interest of fact finding surpasses the interest of protecting privacy.
if the detective did something that he can't justifiably attribute to the reasons of "catching the cheater", then it's forbidden.
