If one commit a felony and during which someone dies, then one can be charged with felony murder even he did
not kill the victim. Say A and B robs a bank, the police come. A and B flee and shoot back at the police.
The police fire back and shoot B to death. A can be
charged with felony murder even if B is killed not by
him but by the police.
Burden of porrf is much loweer than regular murder
because the prosecutor does not have to prove
the defedant has any motive to kill the victim.
They only need to prove (1) the defedant commit
a felony (2) during teh act, someone die as a
result.
