As far as the actual punishment is concerned, I agree that he should be fired, and never be entrusted with any substantial funding.
I agree with you that you cannot punish him as a criminal, if he did not break any law. I think that depends on the purpose of the demo. If the demo earned him praises and accolades, I’d let him go with a destroyed reputation. If he gets additional funding or investment because of the fraudulent demo, I’d suspect that an economical crime has been committed and he should be prosecuted in a criminal court accordingly.
Or, may we can prosecute him for revealing a national secrete (that China cannot yet produce a DSP chip)? Just kidding.
