Morden international laws/treaties governing wars were mostly established after WWII. One of the most important basis for these laws/treaties is RECIPROCITY.
If one party of the war doesn't expect/receive reciprocity from the other, these laws/treaties become more or less useless. This is one of the arguments to establish Camp Gitmo and other facilities to hold "enemy combatant" in stead of putting them through regular legal system.
Technically Japan's rape of Nanking and other atrocities against civilians/POWs were not war crimes because there were no such laws back then.
But Japan suffered extensive stragegic bombing, plus two Nukes. Another example of 你做初一,我做十五。
