Before 1949, there wasn't any international convention regarding protect civilian lifes. Therefore, there was nothing legally against targeting civilian. The fourth Geneva convention put civilian in the protected list, which made the signers responsible for that. No until 1977, there had not been "crime against humanities."
And most important of all, I have never seen a losing side of a war trys the winning side for war crime. There might be complains, but until someone or some group takes down the "winner," the later could never been tried.
