The lawsuit originated from an online article, “Academician Candidates Straddles Two Boats,” published by Dr. Fang Shiming in his well-known pen name “Fang Zhou-Zi,” when the Chinese Academy of Sciences (CAS) announced its 2005 candidate list. In the article, Dr. Fang presented solid evidence and charged the plaintiff, Dr. Xiao Chuan-Guo, then a CAS academician candidate, with a series of dishonest and unethical activities and academic misconducts. They include taking multiple full time positions simultaneously in both America and China, lying in his resume and his overseas work experience, exaggerating in his scientific publications and his research achievements, misleading in his awards, prizes, and other honors, and violating the principle of informed consent in clinical research on human subjects. Subsequently, Dr. Xiao Chuan-Guo filed a lawsuit in China against Dr. Fang Shi-min and the media that either published whistle blowing article or discussed the issue, accusing them of defaming his reputation. After the first trial, the court adjudged that Fang Shi-min lost the case and he was required to apologize to Xiao publicly and compensate him financially.
